Governing Law & Venue

These Terms of Service and any dispute, claim, or controversy arising out of or relating to these Terms or the use of this website shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflicts of law principles.

Any legal action or proceeding arising out of or relating to these Terms or the website shall be brought exclusively in the state or federal courts located within the State of Delaware, and each party hereby irrevocably submits to the personal jurisdiction and venue of such courts.

No Waiver; Severability

No waiver by Mountain Advisory of any term or condition set forth in these Terms of Service shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Mountain Advisory to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms of Service is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be enforced to the fullest extent permitted by law, and the remaining provisions of these Terms shall remain in full force and effect.
